To help future home buyers navigate new construction choices in beacon hill, Below are Court CONTESTED PRoJECTS AND projects without a builDING PERMIT

39 Beacon Hill Road - the old airport beacon lot.  Beacon Hill has been used for speculative projects that vanish with deposits after being unable to obtain a permit. This project  boasts units already pre-sold but has no known building permit issued in the past five years.  PBHA monitors public posting of building permits every two weeks. 

 

12 Fan Coral road - Villa Sasha  permit issued in late 2021 for 4 story 12 condos on lot deeded for single family home.  Permit was objected to  in December 2021 that resulted in the permit being revoked in early 2022.  BUT same permit was secretly reissued with a new date stamp of Sept 8, 2022.   PBHA was never informed but found out by accident in March 2024 and filed a court case. On April 28th, 2025 PBHA won the case and the permits were revoked by the courtl

PBHA won the six year battle over corrupt practices. "Phoenician"  land deeded for 3 single family homes, secretly rezoned commerical with a height increase from  6 to 24 meters, then issued a permit March 2024 by VROMI Minister Egbert Doran.  The project would add 34% more residences to the already overcrowded pennisula. PBHA had the permit revoked on June 30,2025 by the court.  The project owner appealed and PBHA won the appeal on July 22, 2026.  The building permit remains revoked!

30 White Sands Road - The Drake received a permit in October 2024 for the forth floor.  Previous presales buyers have won their court case to be refunded.  The building has been foreclosed upon according to Charley Dahan, original land lease holder, who has taken posession to pay the bank.  Permit for fourth floor was revoked Jan 2026.    Construction completed while the permit was under objection is  at the owner's risk.  Awaiting court date to have the unpermitted construction torn down.

MORE INSIGHT FROM THE CARAVANSERAI TIMESHARE OWNERS/VICTIMS

Please allow me some space in your newspaper to address the wonderful people of St. Maarten. 

My wife and I purchased March timeshares at Caravanserai in 2003. It was a wonderful place. A few years later it was levelled for reconstruction. We patiently waited quite a few years for its completion, and in the meantime purchased an additional two weeks in December, so our sons and their families could join us, as they are teachers and their off-time is limited. 

When we were finally able to use our new March unit, it didn’t take long to realize that Mr. Manek knew nothing about hiring, personnel management or business in general. When we learned that Scotia Bank agreed to lend him $16,000,000, we suspected that the bank did not do their homework and may have their own personnel problems. Next time, maybe they will poll the timeshare owners to get some first-hand input on a borrower’s ability and integrity. 

As is known, Manek disappeared and so did a bunch of the timeshare owners’ dreams, timeshare purchase cash, as well as maintenance fees for 2014. Following bankruptcy, the resort was sold to Ray Sidhom, a rich American. He preceded to null and void the contracts of more than 2,200 timeshare owners, some of whom (like us) will have a hard time dealing with the loss. While, so far, his ruthless action has the approval of the island government, it is nevertheless a criminal act. We’re ashamed to know he is from our country. 

What is most disappointing up to this point is that the St. Maarten government has allowed this to happen. We fell in love with the island and its residents 15 years ago, and still believe it’s inhabited with the friendliest people we have ever known. 

Our hope is that one or more of your leaders will have the courage and integrity to do the right thing. Unlike our leaders, we hope they realize that if they are not part of the solution, they are part of the problem. Please stand up and tell this pathetic coward and his body guards that he cannot infect your great island with his heartless greed.

The owner of this property attempted to build higher than permitted and to subdivide their building into separate condos. 


PBHA prevented the subdivision and the height was prevented by a court case Dambrink Vs Bacchus 2015

This project has also been subject to pre-construction buyers taking the builder to court to refund their deposit.

Property owners were approached by a developer to build multiple condos on the point land.  The project violates the property deed restriction of a single family residence and was rejected by PBHA with the counter proposal of a single villa with a guest apartment.
